When you pay off your mortgage in Scotland, your lender can return any paper title deeds it holds.

You may receive few documents, as property information is also held by Registers of Scotland. The lender’s mortgage security is a separate matter and may remain on the property record after the balance has been cleared.

Your lender should send confirmation that the mortgage account has been closed. Keep this letter, as it gives you a record of the repayment while you check what has happened to the deeds.

Will Your Lender Return Your Title Deeds?

If your lender has original deeds, ask how they will return them. Some documents may already be with you or with the solicitor who handled your purchase, so the amount of paperwork you receive can vary.

You can also ask your lender if it holds anything else relating to the property. This is more useful than expecting a particular set of documents to arrive, especially if you bought the home when its ownership details were already held digitally.

Keep any original deeds you receive somewhere secure. They may contain information about boundaries, access rights or responsibilities affecting the home.

What if You Do Not Receive Any Deeds?

Not receiving paper deeds does not mean your property details are missing.

Most Scottish properties are recorded on the Land Register of Scotland, where a title sheet shows the registered owner and any mortgage security recorded against the home.

Some older properties remain on the General Register of Sasines. Its records are arranged differently, though you can still ask Registers of Scotland to help you find the relevant property information.

If you need a copy of a document, check what your lender and solicitor already hold first. Copies of registered deeds can be ordered from Registers of Scotland, usually for a fee.

What Happens to the Mortgage on the Property Record?

A Scottish mortgage is usually secured against the property through a standard security. Your final payment clears the borrowing, though the security can remain on the property record until it is discharged.

A discharge is the formal removal of that security. It requires the lender’s approval and must be registered with Registers of Scotland. Your repayment letter alone does not update the property record.

You do not have to arrange a discharge immediately. A standard security can stay registered after the mortgage has been repaid without meaning that you still owe the lender money.

It could take extra time to remove later if you sell or transfer the property.

What Should You Keep After Repayment?

Keep your lender’s confirmation that the mortgage has been paid off, along with any deeds it returns. If you arrange for the standard security to be discharged, keep confirmation of that as well.

If you plan to sell, your solicitor can check the property record and deal with any security that remains. If the sale is part of a move, our article on using a Scottish solicitor to buy a house explains their role in your next purchase.

Borrowing Against Your Home Again

You may decide to take out another mortgage after paying off the previous one, perhaps to move home or fund improvements.

Having no outstanding mortgage gives you a different starting point, though a new lender will still need to assess your income, the property and the amount you want to borrow.

Our mortgage advisors in Scotland can look at those details with you and explain which mortgage options may be available.

If the old standard security is still on the property record, the solicitor handling the new borrowing can advise on how it should be dealt with.
